Yes I have recently migrated from IB to ESA, when I phoned over ESA award over points she wounding tell me all she said was I had more than enough (I felt she was thinning you should count yourself lucky.

I am trying to understand the differences in mobility and mobilising.

I can't believe this decision I am a retired nursing sister and am fully aware of my condition, however the doctor examining me hadn't heard of my condition and didn't know half of the tablets I was on.

Do you advise asking for ESA and DLA questionnaires or just go to appeal?

I will go and see GP to get further evidence ASAP but unfortunately can't see consultant for a few months.

I just can't cope with this pressure but thank you for being there.



Hi Lm,

The DWP DM has been known to use an ESA Medical Report, as evidence in coming to a decision on DLA and vice-versa.

You should treat the ESA and DLA as two totally seperate issues, and therefore two appeals if you wish to do so.

You can request the documentation used in coming to the decision/s, see :

DLA Medical – What forms to ask for?

Requests for the above can be made over the phone, but should be backed up in writing, keep copy.

Do not miss your one month deadline to appeal though, if the above have not arrived

To gain a better understanding of "mobilising" have a look at :

As you can imagine i've not slept all night with worry, i've scanned forum all night, so sorry for picking on you both. Ive arranged DR's appointment he wasn't asked for any evidence.

Just a few quick questions:

Welfare rights or welfare rights solicitor?

What goes first GL24 or SARS? ( should I ring for med reports or write)

Do i just print and send in GL24 form, not too sure what to put in reason to appeal? do I wait for letter I am about to request all medical forms from DWP and DM with your template letter.

As you know increased care component but lost HRM, am I just appealing Mobility part, as am happy with the increase to MRC.

Can I request ESA medical report also as they have used it to make decision, IN hindsight I should have appealed WRAG group also but i was lead to believe I was lucky getting that.

The ATOS med for DLA didn't have my consultant letters so i gave her my copies, will she have forwarded them to DM.

I am so sorry for going on as I am in so much pain and taking extra meds so have to keep coming back to forum and then forgetting what Ive looked at.

Hi Lm,

A good Welfare Rights Adviser/Officer, can sometimes be better than a solicitor, as they have more experience in benefits appeals etc.

However, your choice may be that of "Hobson's", as good representation is becoming harder to obtain.

You can send them both ASAP, the DWP will have upto 40 days to provide the documentation/information that you may request, under Data Protection Act 1998.

Yes you can print off the GL24, and fill it in by hand, them post it off, see :

Sending Documents to the DWP or ATOS

There is a pro-forma request for an appeal in our ESA & DLA Appeals Guides.

You can keep it simple initially, in that you disagree with the decision, and will provide more evidence ASAP, you can also state that you will be seeking representation, and if it is obtained, you will also forward details ASAP.

You can specifically state that you wish to appeal the Mobility decision, however there is a risk involved in that your whole DLA award will be looked at again.

A professional WRO should be able to risk assess the chances of your Care award being lost or reduced.

You can make request for any ESA or DLA documentation used as evidence in making the awards over the phone as soon as you wish, but back up in writing or SAR.

As you will see in the GL24 form, you can make a late appeal (ESA WRAG) upto 13 months after a decision has been made, if you can show good cause, again you may need professional help with this.

The DLA "doctor" "should" have forwarded copy of the Consultant's report to the DWP DM, however to be sure, you may wish to attach copy to the GL24.

I really would advise you to read the FAQ's and Guides from the links that I have previously provided.

I realise it can seem a lot to take in, but it will enlighten you, and help with your appeal/s
