I have been on incapacity benefit for 12 years and I dont know what to do. I have cervical myeloathy degenerative disc disease osteo arthritis. CRPS IBS plus other problems I can go out alone I use a wheelchair I am in severe pain 24/7 on the whole works morphine etc, plus morphine for breaktrhough pain and they have said that though the understand I am ill they may be able to give me some kind of operation in the future that may help me get back to work? I am devastated I dont know what to do, please can someone tell me what I have to do now. someone told me I take my doctor with me to an appeal but I dont think that is correct. I am sorry it is probably already on here but I cant think straight please can someone offer me some advice where I go from here. thank you very much.

Congratulations on making it into the WRAG, not everybody being transferred from IB has achieved that.

You can appeal the Decision if you believe you meet the criteria for the Support Group, see

Qualifying for the Support Group

Our ESA appeal guide explains the process and things you need to consider, see

www.benefitsandwork.co.uk/help-for-claimants/esa

You might want to look at some of the other dopcuments used to make the Decision on your claim

ESA medical – what forms to ask for?

You should have also have a look at the following FAQs

Is there any risk to challenging a decision?

How long do I have to appeal?

How to submit an appeal

12 Month Limit for ESA(CB)

Do I have to attend WFIs while I appeal?

I've never heard of anybody taking their GP to a Tribunal, I doubt that they would do this, but in principle there is no reason why a claimant should not do this. A more likely approach would be to ask them to comment on the ATOS medical report
