Hi

I am wondering how to go about letting the DWP know about a change of circumstances. I was put in the WRAG group in January 2012. My symptoms have become a lot worse since then and I feel I should qualify for the support group. Do I ring them up and ask them to look at it or do I submit Doctor and Consultants letters and do it formally? Is it a reconsideration I ask for or a supersession?

Hi J,

It would be a Supersession, in which case your ESA WRAG award would be re-assessed, so there is "some" risk involved.

You would have to inform the DWP in writing, and you may wish to take professional advice.

Hi J,

Just to add, you could send copies of any fresh evidence that you have, but remember, to qualify for the SG, you would have to identify any new limitations that you now have as a result of your deterioration, and how they tie in with the SG descriptors.

It is most probable that a new ESA50 would be sent to you, in which case you could again include any fresh evidence that you have with the ESA50, when you return it.

Thank you very much Bro for your reply. How would I start a letter asking for a Supersession? I am starting dialysis due to kidney failure, do you think this might entitle me to the Support Group?

Hi J,

I do not believe that having dialysis is covered under the SG exceptional circumstances in itself.

However, any "risk" involved due to you condition could qualify you under SG Exceptional Circumstances (ESA Reg 35)

As in this extract :

"by reasons of such disease or disablement, there would be a substantial risk to the mental or physical health of any person if the claimant were found not to have limited capability for work-related activity."

Thank you very much Bro, it is greatly appreciated. I suppose the only thing that might stand in my favour then is the extreme tiredness I experience and pain because of the kidney failure. Would I need to show then that because of this there is a risk to my health if I had to attend interviews, training etc?
