dla appeal

Ive just been told my doctors report has been recived and i should get a dla decision either this week or next week. My doctor said to me i probely would get dla and ive recived it in the past(my renewal was refused in april and i dint feel like appealing) but i think i will probely have to appeal this time as i know how toutgh it is to get dla nowadays. My question is should i allow the decision maker to have another go or go straight to a tribunual. i read that a tribunual is more sucsesfull than asking the decision maker to look at it again. Is this true and could you tell me some sucsess rates of apeals reviewed by decission makers and tribunuals thanks megan

A mandatory reconsideration is carried out first when an appeal is submitted, so asking for a recon first just delays things even further. I'm afraid I do not have any figures for the success rates of recon versus appeal.

Hi m84,

B&W advises that you should always appeal in the first instance, as all appeals receive an automatic reconsideration anyway.

Therefore this only takes the one action.

Whereas if you only ask for a reconsideration, and this does not go in your favour, you would then have to submit an appeal as a seperate action.

It is upto you though, as to which course you take.
