I first applied for esa in Sept, 2011. I received 0 points at my medical and appealed. The appeal took place in sept 2012. It was horrendous, outcome still 0 points. I then applied to the upper Tribunal who have agreed to look at my case. In the meantime I had to lodge a new esa claim and was put in the WRAG. Do you have any stats on the success rates at the upper Tribunal.

I have not seen any statitics in connection with the Upper Tribunal.
The most likely result, if the agree that there has been an Error of Law, is that they will order a new First Tier Tribunal be held with a new panel and a direction in regard the original error.
