Hi, just a quick enquiry while I am preparing my forms.

I may have read it on here, was recently but read so much recently hard to keep track.

I read somewhere that a person asked Atos and DWP if they could be sued if they did anything at the medical which resulted in injury and further distress/complications to a persons health and the answer was no.

The person stated that they found out that if you were to attended a medical and tell them you would allow them to conduct the medical but it was unconsented that they could be sued if they did anything to you?

Only reason I ask if my last medical I attended I was recovering from a neck injury, I made it clear several times so the doctor thought it would be an excellent idea to place both hands on my head and push down very hard and fast resulting in a nice crunching sound, he claimed that was normal.

Thanks for any advice on attending a required medical but informing them you are allowing them to conduct it without your consent.

You either consent for an assessment or you don't. I fail to see how you can say 'OK, go ahead but it is without my consent' as the two statements are mutually exclusive!

Never got chance to say thanks last night, thought I would ask as to me it seemed to contradict itself when I originally read it so think it is likely someone just writing a load of rubbish on another site but might be helpful if anyone else has read it.

I've read somthing about this on another site , its not about the assessment as a whole but any physical at the end of a face to face assessmant . The Atos disability denier has to ask for consent before any physical examination , Atos tell them this means anyone being examined cannot sue for any resulting injury as consent has been obtained , I doubt this is true though but I'm not a solicitor . What dors the team think ?

As a HCP, I remained responsible for any actions I carried out whether or not the 'patient' had given consent. I was expected to use my preofessional judgement for the benefit of anyone I examined and consent would not have been a defence if I had caused harm.
