Can you please repost your query in lower case, as block capitals come across as shouting to members who use screen readers and other software to read the forum.

Mods would normally rewrite posts such as this, but yours is rather long for that and we are quite busy.

my son is receiving dla at the lowest for both care & mobility. he has m.e./cfs/fibromyalgia amongst other conditions.

we received a letter stating that he is receiving income support/incapacity benefit/severe disablement benefit. i wrote back giving copy of letter from two years ago when he came off income support, which they acknowledged i also enclosed letter from dla stating he has indefinite dla.

when they phoned the other day they said they were sending out forms to move my son over to esa i told them i had written to them enclosing supporting documents, but they said they had not yet received this. the person on the phone was speaking from wales and i had to send the forms to chelmsford. surely my son's records should be up to date. i did ask them to update his records in my letter and if possible confirm to us that they had done this.

i said to the lady i did not think you could go from dla to esa (explained what i have put above that dla is his only benefit). she just replied that to make sure the forms are completed and sent off as the government is paying his n.i. contributions. i have found out that they are not. any help would be appreciated. thanks in advance

Hi h9,

DLA has nothing to do with ESA.

Is your son in receipt of Income Support, on grounds of incapacity, Incapacity Benefit or Severe Disability Allowance, (IS, IB or SDA) ?

If he is, then all recipients of these benefits are being transferred over to ESA.

If your son is in receipt of IB, IS or SDA, may I suggest that you read our : IB, IS, SDA, Migration to ESA FAQ’s

Being in receipt of DLA does not exempt claimants who also receive the above benefits from being transferred over to ESA.

With respect to your comment regarding the geographical location of the office that you were told to respond to, the DWP have set up reassessment teams all over the country, so it might not be a location that is near to where you live.

I don't know whether you have yet received an ESA50 Questionnaire, but if you have, you should also read the relevant FAQ's in our :

Hi h9,

It is not totally clear from your post, but it is possible that your son could be receiving NI Credits only.

If he is, you need to find out which benefit he is in fact receiving these for.

A claimant can receive NI Credits only with ESA, if their 365 day entitlement to payment of CB ESA has been exhausted.

In a scenario such as this, they still have to comply with any requests to fill in ESA50,'s or attend face to face assessments to maintain a live ESA claim. Their NI Credits will go towards their State Pension.

sorry about putting it in upper case - will not do it again. My son only receives dla. Up to 2 years ago he was on income support as well but he sent a letter coming off income support as I had bought him hiis flat which had to be in his name as it was an ex local-authority. receives DLA of £40.22 per week.

I am of the impression and I do not know if I am right, but when she said he is being moved over to esa because the government pay his stamp, I have checked and they are not - I believe they only pay your stamp if you are on incapacity.

May I ask if he has to go over to ESA if he does not want to. DLA is a separate entity I believe, and we are quite happy at the moment for him just to stay on his DLA He is on this indefinitely and I have sent them a copy of this letter, also a copy of the letter he wrote 2 years ago that he did not wish to claim income support anymore. He is only repeat only, getting DLA and I was under the impression that his stamp is not being paid. He opted out in 1986 and the government stopped this a couple of years ago and I have checked and he has not been credited. I thought he could stay on DLA and we will try and find the mpney and buy a stamp. Your advice on this please.Thank you for your interest (good site)
