How much longer will I have to wait ? was created by phrank
Having been placed in the ESA support group for 2 years, I was summoned for an ATOS medical last August. I failed the medical having scored 12 points and put in an appeal against the decision which was logged by the DWP on the 17th of September 2012.
I have repeatedly phoned to check the progress but can’t seem to find out what is happening. I last phoned over a month ago and was told it can take up to 6 months for an appeal to be looked at.
Such is my frustration, I finally put pen to paper to see if I could find out anything - this was 2 weeks ago and up to now I’ve heard nothing.
It is now 7 and a half months since the appeal was logged.
I just wondered if this was normal.
Any help or advice would be gratefully appreciated.

It is not clear from your post whether your appeal is still in the Reconsideration stage or whether it is now with the Tribunal Service?
If it is still with the DWP then this is an unreasonable period for it to have taken and I would be tempted to make a complaint on this basis.
Complaining to the DWP
If it is with the Tribunal Service the we are still seeing 10-12 months from lodging the appeal to actually having a hearing, although some areas are quicker.
If you are receiving Contribution Based ESA, then you are only entitled to the ESA Assessment rate for 365 days.

Thank you for that. My appeal is at the reconsideratrion stage. I will phone them tomorrow and try to find out what is going on.
You say that, if I am on contribution based ESA (which I am), I will be only entitled to the base rate for 1 year.
I wondered what will happen should I go over that period as I live alone and have no other means of support ?

Sorry, should have added, if you are eligible for ESA(IR) then you will be transferred and payments will continue.

Phew....... thanks for that, Gordon - I was flapping a bit then, I think someone from the DWP said something about that in one of my many phone calls to them.
I think the guy said something about phoning nearer when the year was up and I would have to fill a form in or something and be transferred
