hi mods please could you help my husband has applied for dla. we sent for a dla in early march the form did not arrive. phone for another on the 4th april we got the form. filled out the form in had to be back with the dwp by the 20th may. which the have got, we have got a letter from the dwp. to say they have now forward the dla claim has been passed to the pip unit as a claim for pip. we asked due to the change over what we would the claim be classed as dla or pip. we wre told dla as it is before 8th april. and the stamp on the form 4th april return 20th may. called the dwp they say we have been informed with the wrong information. can you tell how stand with regards the claim for dlla. how they look as this form. thxs carol

If you claim forms were dated by the DWP with a date before 8 April 2013, then even if you are in the PIP trial area it should be treated as a claim for DLA.

A claim for DLA cannot be simply turned into a claim for PIP, the claim form and more importantly the qualifying criteria are completely different.

I have to admit I am not clear how the DWP have left your claim for DLA, are they saying that they made a mistake in suggesting that it should be PIP?

Or, are they saying you must make a claim for PIP because you are in the trial area?

As an aside from Gordon's advice about your query, it appears that your username might be your real name. Many people prefer to use an alias in order to maintain some anonymity. If you would like to change your username you can easily do it by following the advice in this FAQ

thxs gordon we are in the area for the trial area. so i do not know how we stand. we called the dwp . we are waiting for a manager from the dwp to call back within 5 working days. . can you suggest how we go from here . thxs

Until you receive the call, there is nothing I can suggest beyond what I have already posted.

It all depends on what the dates on the form were, the first date is the date that a claim will be considered as having been made on, providing the form was received by the DWP before the second date.

If the first date was after 8 April or the form was not returned by the second date, then because you are in the trial area you will be required to claim PIP and will have to complete a new claim form.

If the first date was before 8 April and the form was returned in time, then it should be classed as a DLA claim.
