ATOS SAR

I was phoned earlier today by the DWP about a SAR I sent out exactly 40 days ago.
It was queries I had on my earlier SAR for LT54 ect; in which i had waited 62 days to receive. Only after a ICO threat letter
The DWP told me that, because it was queries on what the ATOS HCP had quoted and why I met the criteria for WRAG. I would need to get a SAR from the ATOS HCP. Is this normal

Hi B,
All ESA documentation, is held by the DWP. ATOS receive a referral from the DWP when it is time for your assessment/reassessment.
Once ATOS have carried out the "Medical" side of the assessment, your file and all documentation is returned to the DWP.
An LT54 is a DWP Decision Maker's report, ATOS will never have access to an LT54.
Have a look at the description of an LT54 on this FAQ :
ESA Forms

Hi B,
The ESA85A is "written" by ATOS, but is then returned to The DWP.
ATOS will not have any of your ESA documentation, once a decision has been made.

I emailed the DWP this morning on the information you gave me above. I also issued them with an 14 day ICO threat letter stating under the data protection act 1998 I have a right to ask about any logic involved in any automated decisions made about me
I received a quick response stating the reasons I have requested fall into a different category and that my request has been refered to the relevant team leaders
What would be the next step if the the relevant team leaders do not respond

Hi B,
I really don't know, and could only speculate.
Maybe, some of the information that you are requesting comes under the criteria of "Harmful Information"
This is covered under the heading ;
" 4.2.1 Harmful Information"
On page 145 of The WCA Handbook, 2nd link from the bottom of this page :
ESA Claims Guides
This,of course, is only a suggestion, and may not be the case at all.
