Placed in the WRAG but better suited to the Support Group, I asked for the ATOS doctor's decision to be looked at again, carefully detailing and referencing the areas of conflict as I saw them. Their response has been to send me a newer version (ESA50 01/13) of the same form. As they clearly have the valid, signed older one, what could possibly be their motivation? Are the questions subtly more incisive? Are they looking to trip me up by me supplying different answers to the same questions? (I did keep a copy).

I smell a rat, but I don't know where it's going.

Has anyone else experienced this. Any advice gratefully considered.

Hi E,

Well done on being awarded ESA.

If you have asked for a reconsideration, or submitted an appeal, this does not usually prompt a new assessment with an ESA50. How long is it since you filled in the last one?

The only way you will really find out what is happening is to contact DWP and ask. it is likely that the first person you speak to will not really understand the system so the best thing to do is to ask for an escalation, which will involve a call back from a more senior employee.

While you are awaiting a reconsideration you are obliged to undertake Work Focussed Interviews if asked to do so. If you have actually appealed then you will not have to participate in the Work Program but this does not apply if you have only requested a reconsideration.
