IB to ESA and PHI

Hi

My partner has had the dreaded letter regarding moving from IB to ESA and I have joined the site to help him through the from which will be with him soon.

He has been sick will chronic anxiety and depression since 1997 and has been receiving IB and PHI which is a private policy he took out many years ago and not associated with his previous employer.

My question looking on the black side, is there anyone with experience of having private PHI being found fit for work and what the insurance company do in these circumstances? He has only recently with his GP's report been advised his PHI is continuing following the annual review.

Also as it is Private PHI does he need to mention it when filling in ESA50, from looking at the online version nothing is asked about it. He has never mentioned it in regard to IB as no kind of income questions have ever been asked.

With regards to the migration to ESA process, have a read through this document :

As you will see you first receive a letter, then a phone call, (which you don't have to take) then the ESA50 Questionnaire.

Once you have received the ESA50 Questionnaire, you must fill it in and return it to ATOS by the deadline given.

Thanks I have read all that today, but nothing on there that asked about PHI payments when completing the ESA50, am I missing something?

Hi p,

The ESA50 is a Questionnaire to gather evidence to see whether you have Limited Capability for Work, (LCW) which gives WRAG entry, and/or Limited Capability for Work Related Activity,(LCWRA) which gives SG entry.

Therefore, being in receipt of PHI is not relevant to the questionnaire.

As Gordon has advised in the post that I directed you to, we cannot advise regarding PHI, you would need to get face to face advice.

Where to get advice?

Your priority would first be to fill in the ESA50, and then seek advice regarding the PHI.

Hi

Just found this

Where the claimant
1. receives a payment under a permanent health insurance scheme and
2. had contributed over 50% of the premium
then the payment is not deducted from ESA

My partner paid 100% of his premium.

Just would be really interested if any other members have had any experience of the attitude of the insurance company paying the PHI if the person claiming ESA is found fit for work or is put in the WRAG.
Just to add my partners PHI is paid so long as he cannot return to his old career, not stopped if he can do any work.

This is why we cannot advise on PHI, as the terms and conditions from one provider to another, may vary.
