If you think that your ESA50 was not as good as it could have been, then it being missing could be to your advantage, however, if you think it was an accurate reflection of your problems, then it probably does not help your case that it is not available.
Most Tribunals are decided on the day as a result of the answers given by the claimant during the hearing, however, that does not mean the panel will not have looked at all the evidence in advance and the ESA50 is something they would expect to see, I would not be surprised if the DWP were chastised for losing it.
