Hoping for some advice, I have a date for my DLA tribunal but am wondering whether withdraw my appeal? I have an appeal in for ESA which is now going to tribunal and I'm wondering if I lose the DLA tribunal it might affect my chances at the ESA tribunal.

I'm not sure I really qualify for DLA, only applied due to Citizens Advice Bureau saying I should. I never had a medical for the DLA they just used the information from the work capability assessment and turned me down flat two days after getting the form so I think my chances are very slim and am worried it might affect my ESA tribunal chances. Has anyone else had a similar experience or does anyone have any advice?

Hi C,

We can't really advise you whether to carry on with your DLA appeal, or not.

If the CAB feel that you qualify for an award, then that may be the case.

DLA and ESA have different qualifying criteria, and ESA is quite rigid with respect to the qualifying descriptors.

The DWP will have to justify what it was in The WCA report that was used to deny you a DLA award.

The other thing that you should take into account, is that if you withdraw this DLA appeal, you will not be able to apply for DLA again, it would be PIP.

You may wish to discuss this with CAB, but going forward with your DLA appeal, shouldn't have an adverse effect on your ongoing ESA appeal.
