thanks Bud all it said in that section was that taking the available evidence into account I did not have limited capability for WRA and that they also felt I did not meet any of the descriptors, that was as detailed as it got.
Since then I have provided medical evidence from various people, this still didn't make a difference and unfortunately they have managed to loose a letter from my Consultant so that hasn't even been seen yet.
Just sitting down now and doing yet another letter to them.

Hi Ray
Its now up to you to point the Tribunal to your evidence on how you meet the criteria for the support group, its about your limitations and restrictions you have with your condition not the condition itself, copy how the Dm has made a statement and then put either (Evidence 19) or (page 19), you could also use this
Section 4 Facts of the case.
My evidence strongly suggests that I do meet the criteria to be placed in the supprt group
Start explaining your restrictions and limitations how you meet the criteria for the descriptors you are after, use repeatedly reliably, safely and for the majority of the time
But do not forget Regulation 35 that should be on section5 the response No5
Are you a serious risk to you or some one else`s health at a work place ie; are you at risk from falling, side effects of your medication, take everything into account
Make it short and straight to the point ( Sample), my mobilty is extremely limited ( evidence 19,21)move on to the next one (I have difficulty moving from a sitting position to standing position (evidence 19) Etc
Try and keep your submission to two pages only cherry pick your best points dont answer everything , hope this helps

PLEASE READ THE SPOTLIGHTS AREA OF THE FORUM REGULARLY, OTHERWISE YOU MAY MISS OUT ON IMPORTANT INFORMATION. Nothing on this board constitutes legal advice - always consult a professional about specific problems

As a former Welfare Rights Lawyer and DLA Tribunal Member I would agree with this strategy.
