Can a person who is a 24 hour carer for their husband (not claiming carers allowance) claim ESA? Thanks

Yes they can, they would obviously have to obtain a fit note from their G.P., and fill in an ESA 1 Form.

You should be aware that assumptions may be made, if the actions involved in your caring responsibilities are contradictory to the limitations that you state that you suffer from, due to your medical conditions.

As an example, it may be accepted that an ESA claimant with MH issues and resulting limitations could offer physical care, likewise it could be accepted that an ESA claimant with PH issues can offer care, such as prompting, supervising, overseeing, etc, etc.
