Hi All,

Are (anybody claiming ESA) still entitled to the ESA assesment rate when appealing to the FTT (First Tier Tribunal), or has this now been abolished ?

Thanks,

Rob.

The Mandatory Reconsideration changes have not come into effect yet, but they do change the payment of the ESA Assessment rate when appealing.

The change to the system means that a Reconsideration must be carried out by the DWP before an appeal can be made, the Assessment rate is not payable during the Reconsideration period, but once this is completed and the claimant then lodges an appeal it becomes payable.
