Requesting a statement of reason
- bro58
I have merged your posts from tonight with your previous query for continuity of information.
You can request the ESA85A medical report, the LT54, and an ESA113 if you are sure that one was sent to your G.P.
You could request the above, then add that you are requesting copy of all documentation used in coming to The WRAG decision.
It is not likely that there will be a score sheet, the documentation may simply state that you have fulfilled the criteria for Limited Capability for Work (LCW) and are therefore in the WRAG.
You can request these by letter, or use a SAR Form :

From this page :
DWP Data Protection Policy
Any SAR should be addressed FAO The Data Controller at the address of the benefits Office dealing with your ESA.
Do not miss your one month deadline to appeal if they have not arrived. You can always send further appeal information when you receive them.
The important issue in your appeal is to reiterate how and why you qualify for The SG under at least one of The SG Descriptors :
Qualifying for the Support Group

Last week I contacted my MP, and would you believe it she contacted me wanting more information, which I gave her and she has written to me and has said that she has asked for a complete explination of how I was assessed and that she will be back in touch,
I have requested to see copies of information as has been suggested by filling in a SAR. I sent my appeal form and it was signed for today. So now I sit and wait. Thank you so much for your help. I would not have had a clue had it not been for this site.

Could you please tell me what is a rough time limit on receiving a reply once you have sent a request via a SAR form. Also will I get any notification/response regarding my apeal request. Thanks in advance.

The DWP have 40 calendar days to respond to a SAR although they are usually a lot quicker than this.
You should receive written confirmation that your appeal has been received within 10 working days.

I have just rang DWP, I swear they dont have a clue! I had to explain what a SAR was! I am told that a valid apeal has been received but no confirmation is sent now, I should just wait. Thanks for your help Gordon, much appreciated.
