Claiming ESA for dependents was created by Paul
Hello,

Could anyone advise me if I can claim additional ESA for my 2 dependent children, and possibly my Wife.

I am still claiming IB. My Wife was claiming IB, and was claiming a supplement for our 2 children She was migrated to ESA (Contributary) and put in the WRAG. We appealed, but she was unable to be put in the support group. She felt she had to end her claim due to the constant harrassment by the DWP. The final straw was last week when the DWP Visiting Service announced they would visit her at home. She wrote to the DWP and cancelled her claim in writing. My Wife will not be claiming any benefit. We still have my IB, Child Tax Credits and CB.

Any advice would be appreciated.

You need to get face to face advice

Where to get advice?

If you are still claiming IB then you cannot make a claim for ESA, you must wait until you are transferred.

ESA takes no account of any children the claimant might have, it may be possible to claim an Income Related top-up to the ESA(CB) that you will be transferred to, this will pay additional money for your wife, however, this will be dependant on your personal circumstances which includes household income, assets and savings, and any hours that your wife might be working at the time of your transfer.

Hello,

Thanks for your reply.

My Wife does not have an income, and will not be claiming any benefit. We have no savings.

I hoped to claim for the children on my existing IB claim. I have wrote to the DWP requesting information or forms to apply for the children. My Wife only ended her claim on 24/09/2013. She will not be claiming any benefit, or applying for employment.

If you are successful in claiming for your children on your IB then this amount will be carried forward onto ESA, but may prevent you then claiming an ESA(IR) top-up, as posted earlier you need to get face to face advice if you can.

Hello,

Thanks. I will try and get an appointment with the CAB.

I had hoped to add the children to my IB before I was moved onto Contribution based ESA. I hoped it wasn't too late as I have already completed the ESA form and returned it.
