PIP Application Update 3 months 3 weeks ago #250145

Thank you.

My doctor did add that it would cause overwhelming psychological distress in the form she sent to them.
Not that it makes any difference here but I'm a wreck and look so unwell at this point.
I managed to muster the support and energy and tried to take my son out to feed the ducks earlier.. I feel I can't even do that because it'll be used against me.
The DWP rang me while I was out to remind me of the appointment on Monday. I explained I'm too unfit to attend, explained the whole situation and that worst case scenario I don't have time to coordinate with my doctor.
I asked the woman if she could give me as much time as possible and she's rearranged the medical assessment for 2 weeks so I have time. She was reluctant to and said that she was going to write that 'I was okay' to attend the medical. I said "please don't write that I'm okay, I'm not, I don't have a choice". She said she wouldn't. Who knows.

I managed to get in contact with Solidarity the charity that initially helped with my form.
They said that by law the DWP are supposed to make reasonable adjustments under the disabilities rights act and adviced me to get in contact with a solicitor that works within the disability sector.

What are your thoughts on this?

I know I may come across like I'm fine and articulate but if you could see the amount of energy it's taking me to get all of this out.
I'm sat completely zoned out barely able to respond to my son :'(

Sasha

The Equality Act 2010 does require the DWP and its contractors to make reasonable adjustments but the Act is not particularly designed for this situation as you will have to rely on the threat of legal action changing the view on whether an assessment is required or not, the reality of legal action could take months even years.

You also have to consider whether you can arrange anything in time to postpone the assessment and also that this is likely to cost you money.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Dear Sasha, first of all my sympathy on your horrible treatment and difficult situation. Just a thought, can you paste all the bits from your posts here about your struggles into a document that you can read to the assessor if you do have to endure an assessment? Include the dates, and it's similar to a diary about how you feel and how much it takes out of you keeping going to the extent you do? There's a lot of evidence about you not being able to do activities of daily living "as often as required" and or "to a reasonable standard" in what you have said.

Thanks for this, it means a lot.
They're so overpowering it's hard for me not to lose a sense of self as I have no family support.
I'm getting to the point where I feel maybe I should be able to work but as a single mum with a mental health problem, I know this would be dangerous for myself and my son as I just won't have the space to regulate the overload of sensory input.
I know a tribunal will completely understand that and apply the rules but the medical assessors are just going to guide me to saying things that will make me lose my claim.
I've been single for 10 years after horrific abuse and am super vulnerable to isolating and not interacting in the world and I feel like the abuse they're putting me threw is akin to a really abusive partner.

I know I'm not well and not able to manage the things most others manage and should receive PIP support and that I'm a moral person that wants what's right not to 'win'. But they'll happily crush me anyway.

Sorry for the vent.

How's your daughters claim going?

If you have the time and energy, could you explain in more detail what you mean, when you say the act is not designed for this situation, and also the treat of legal action bit?
