Is it true that PIP can change decisions and award before a tribunal case even takes place? It's just that I read it online on other forum posts, i'm wondering if there's any truth to that?

Hi Sam

Yes it is true DWP can review files up to the date of a hearing, we have seen a number of posts on this forum, I have also come across it in my day job.

If you are offered a standard component and you believe you should receive the enhanced component, we advise members to accept the standard component then once it is in payment appeal the decision, that way you will receive some payment whilst waiting for an appeal date, prior to the lockdown in some areas it was taking over 52 weeks for a hearing to be listed.

I applied for PIP and expected to get Standard Mobility at the very least. I was awarded Standard Daily Living. On Mandatory Reconsideration, I was awarded Enhanced Daily Living and Standard Mobility so I decided to appeal. Before the appeal was heard the DWP awarded me enhanced for both.

Oh interesting, so if i was to give you this scenario. I received only 4 points for each and i'm going to take it to the tribunal. Lets say PIP change their decision into a standard one for daily before the tribunal however I feel I should have enhanced, it's worth me accepting it then having to start the tribunal appeal again? because the original decision was to argue no award not the standard? Am I correct in that approach or perhaps i don't need to make a new appeal?

These are decisions that only you can make!

What I would say is that if you reasonably feel that you meet the criteria for an Enhanced award and are willing and able to pursue this at appeal then I would recommend that you accept any offer that the DWP might make and request a new appeal.

But understand, these offers are quite rare and you do need to have some certainty that you meet the criteria for an Enhanced award.
