upper age limit for E.S.A 5 months 2 weeks ago #220633

hi is there a upper age limit for claiming E.S.A. as my sister in law is has been on E.S.A IR for years and has been informed by the D.W.P that she can not claim for E.S.A when she is 59.But have not said what she can claim instead. As she is 59 next year she said she might only have her P.I.P to live on till she is retirement age thats 67 now a days.I thought maybe she will have to go on U.C.Any idea what is going on heare.

I would check what your sister-in-law has been told as 59 is not an age that I would associate with ESA ending. Her ESA should continue in payment, as long as she has an award until she reached State Retirement Age.

It is likely that she will be migrated to UC if her ESA is Income Related before she retires.

Her ESA will be replaced with her State Pension, if her income is low enough then she may also qualify for Pension Credit.
