Hi I have a query about change of circumstances. Last time, at review they tried to say there was due to my physical condition but this was overturned at appeal (paper)

This time they are saying it about mental health giving their reasons as no longer being under the MH team, however we have a care plan and this was the same as at my last review. They are also saying things like I have no formal diagnosis which is wrong, there is lots of evidence about that and ongoing support.

Therefore I can't see their grounds for a change in circumstances. I'm wondering about asking them to explain their reasoning for a change is circs in my MR letter, any idea about doing this or is there a relevant law to ask about? Grounds for supersession something like that,

In my case think will probably do as before and go straight for a paper appeal again as it will be clear on paper this was the same as at last time. I'm a bit confused as to whether the 'change' is from time of last review, or at time of original award however. Any thoughts welcome.

Any change would be from the last time that your award was reviewed, not from when you claimed PIP.

Ok thanks Gordon, that is very helpful. It was very clear at last review this was the case then so feel they are clutching at straws with this one. I'll let you know the outcome.

Still waiting on the decision, according to the assessor's report it is giving 4 points for care and 4 for mobility so no award. Am on enhanced at present awarded by tribunal to next year.

I know it is better not to argue with the opinion part but if they have made big errors like saying 'no formal diagnosis'- when you have one from the consultant, and about no specialist in charge then is it OK to say that and give evidence (which was sent in) also if they have done things like written in parts about dressing for example 'food type is not relevant to this activity' (so it makes no sense) and the same cut and paste stuff for each section then that is well not accurate is it. or acceptable.

Yes, some of the things, just noticing more. We did say the main things, just need to wait I suppose,
