Hi, i called capita last week Monday they done a paper based assessment and forwaded my file to the DWP on the Monday last week. The DM made a decsion on monday just gone giving me the enhanced rate PIP til 2018 (all with the help of this website i really do appreciate it allot! Couldnt of done it with out it) i had further evidence like a diary and a letter i wrote saying im waiting for some letters of support. I called DWP a couple days before decsion was made and she said she would note it down. But the next day i called to see if they had recived my documents and she said yeh its been scanned but the DM hasnt seen it yet as he made the decsion before seeing my other evidence.

So basically if i go for a MR would they look at my PIP enhaced rate again or just mobility? As i am happy with daily living just i feel my evidence just got there lil later. The guy at DWP said he would write down that i sent other evidence in regarding mobility and if he could seeit or get the DM to call me. Can the DM see my evidence and change the award aswel before going to MR?

It is good to hear of your Enhanced PIP Daily Living award !! :)

Thanks for the comments regarding B&W.

It is possible that the DM could change the decision if they feel that the evidence that you sent them before the PIP decision was made, which does not seem to have been taken into account, does give you some entitlement to Mobility PIP.

However, I would be wary of waiting for a call from the DM, as this may not occur.

If you feel that your current Enhanced DL Award is safe,( how many points did you score ? did you just scrape in ? ) and you feel that you should qualify for a PIP Mobility Award, you should not wait for the call, you should instigate an MR request within one month of the date of The PIP Award Decision Notice letter.

Sending Documents to the DWP or ATOS

This can be done over the phone, but we advise that this oral request id backed up in writing to protect your MR rights.

There is always some risk to existing awards when requesting an MR/Appeal, I am afraid that only you can assess said risk.

You could state that it is only the Mobility component that you wish to challenge, however they can re-look at the DL Award as well.

Thanks for your reply! Im not sure howmany points i was awarded as when i called to ask if they had recived my evidence they said a decision on your claim has been made already. which was a suprise to me as capita sent the form in on the 17th and decision was made in like a week i thought it would have taken longer.

I sent a diary of a week how i hadnt left the house even with encoragement from my brother due to agrophobia and anxiety. would this be worth while? Or is the mobility tough on this?

The DWP are marking the Going Out Descriptor very tightly so you will need to show that you meet one of the higher scoring Descriptors for an award.

a. Can plan and follow the route of a journey unaided. 0 points.
b. Needs prompting to be able to undertake any journey to avoid overwhelming psychological distress to the claimant. 4 points.
c. Cannot plan the route of a journey. 8 points.
d. Cannot follow the route of an unfamiliar journey without another person, assistance dog or orientation aid. 10 points.
e. Cannot undertake any journey because it would cause overwhelming psychological distress to the claimant. 10 points.
f. Cannot follow the route of a familiar journey without another person, an assistance dog or an orientation aid. 12 points.

For example the guidance suggests that a claimant would need to have been unable to leave their home for 2 years to meet the criteria for 13e, we believe that this is unreasonable given that PIP only considers a claimant limitations for the previous three months, but you would certainly have to have been housebound for all of those three months to stand any chance of an award.

If you have physical problems with walking as well as problems going out, then you maybe more likely to gain an award, but you need to realistic about the points you may be able to score, as there is no guarantee that the DWP or a Tribunal panel would not extend any challenge to include your Daily Living award as well.

Ok thank you. I will just wait for the letter to come through and see howmany points i have been awarded for daily component. Will also wait for DM to call me to discuss it.

I recived the PIP decsision forms and for daily rate i got 15points and mobility 4 points. Is it worth going for MR now? or do i have a chace of losing DL?
