Hi

Sorry just need help in where I go next, for years I have been on a war Disablement Pension from the veterans gency (med discharged after broke back in parachute accident). Recently as my wife’s hours increased we applied for working tax credit only to be told that we need to claim Universal credit instead as we are in a full area for it.

As I say I get and have been for years get a War Disablement Pension at 90% rate and a number of attached supplimental allowances with that such as Unemployability suppliment, mobility suppliment, exceptional disabilities allowance etc, all from the Veterans Agency. My wife also gets Carter’s Allowance for helping me etc. I also have highly suspected Aspergers Syndrome but have been waiting years for a formal appointment with my mental health team for that due to the cut backs, I even have to travel to Wakefield from Rotherham to have it when I finally do get the appointment!

Getting this one benefit stops my entitlement to the normal benefit path, ie DLA/PIP etc, for example I can’t actually claim ESA etc due to my war pension award.

Now it comes to applying for the UC instead of Tax credits I have had to complete a UC50 Works Capability Assessment despite being awarded Unemployability Supplement and a 90% War Pension!

Why must I jump through hoops when I can’t claim esa due to war pension and surely the Unemployability suppliment And 90% War Pension really says why are you making me do a WCA UC50??

Anyway I am trying to fill in as I am expected but I am struggling understanding the forms on how I answer the questions etc. Is there a guide on how to answer the questions anywhere?

Your War Disablement Pension does not prevent a claim of ESA but it can prevent payment of one. Be aware this is also the case for UC.

You have been asked to complete a UC50 as Universal Credit assumes that all claimants are Fit for Work, the form is to see whether you are or not, UC has it's own criteria for this and whilst it is very unlikely, you could be found FfW despite your pension as a result.

Universal Credit uses the same criteria as ESA so please refer to our ESA Claim guides to help you complete the for,m.
