Hi, I am really getting confused here and would appreciate some help please.
I (aged 56) have been off sick on Peritoneal Dialysis since 29 January 2018 (4 months) and have applied for UC which has now awarded me 'limited capability for work and work related activity' (no need to search/prepare for work), however, I am not receiving any UC payment because my husband (whose 73) receives a pension. (1) Can I claim new style ESA now before my SSP expires or do I have to wait? Current sick note to 26th June 2018. (2) Would I have to complete a new ESA50 as already completed UC50? (3) What happens with my job if I can't go back to work? Much appreciated

1. You should be able to apply for New Style ESA providing you can meet the two Contribution Conditions, in simple terms you need to have worked in the two Tax Years 2015-16 and 2016-17.

I'm unsure if you will need to wait for your SSP to end, if you do then you may be able to make an advanced claim for the day after you SSP ends.

2. Your Limited Capability for Work Related Activity should apply to your NS ESA, so there should be no need for a reassessment.

3. I can't answer this, you need to speak to your HR department and I would also get face to face advice, the CAB have experience in this area.

Be aware, if you are awarded NS ESA then the payment will be deducted from yur UC.
