RECORDED PIP ASSESSMENT - REPORT FULL OF LIES

Please help me I am so worried. I had a lifetime award of DLA for agoraphobia and God forgive me I CHOSE to make a PIP claim. I've recently been diagnosed with ADHD, Autism, Sensory Processing Disorder, Dyspraxia. I am deaf in one ear but don't wear a hearing aid due to sensory processing disorder and I have restricted visual fields. I have a gifted IQ. I also have 6 disabled children.

I used to get lower rate mobility for DLA just for agoraphobia. I've found out I've got a lot more problems than just that. The council give me an adult social care package. I have a lady who will take me out for 10 hours per week which the council pay. So I do go out but I can't go out on my own.

So I sent in my form, which was packed full of information and evidence (lots of it). I asked for a decision to be made on the papers and they refused. They said I had to come in to be assessed. I asked for reasonable adjustments they said no. They said they had to get more information. They said they would stop my benefits if I didn't go. I had no choice. I had a 1pm appointment and they made me wait for two hours. I was so late that my husband had to call social services because we couldn't pick up the children from their disabled schools. I was in bits.

I recorded the whole thing. Mainly because I've got ADHD and I can't remember what I say so I do this a lot. Thank God I did.

I cried during the whole thing it was the most degrading thing I've ever been through in my life. A strange man asking me about sanitary pads and other very personal things. I told him I'm not answering questions that I've already answered on the form.

I've got his report back. He has just told lie after lie. I am reporting him to the HCPC. I've uploaded the recording privately to youtube. YOu can't hear it without a link (or password). I hope he liked being a physiotherapist because he is toast after this.

He's basically said I'm fine that there is nothing wrong with me. I doubt I'll get an award at all after what he's said. He's said I've got no problems with anything at all. It is a joke.

They made the decision today but can't tell me what it is until the computer updates in the morning. They said I can get a mandatory reconsideration. My question is does your money stop while they do this?

Also my disabled son was meant to have a "transfer from DLA to PIP assessment" tomorrow. I've cancelled it because of what happened to me. They are lying and abusing people. I swear to God I am not lying. If someone credbile wants to see the report and the hear the recording they will see.

I also qualify for legal aid and I think this is disability discrimination. Please help and tell me what to do.

What did you expect to score for?

To receive a Mobility award for Agoraphobia you will need to show that you cannot on the majority of days undertake a journey. See our PIP Claim guide for more details.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

I was transferring from DLA voluntarily. I also have Autism, ADHD, Sensory Processing Disorder and Dyspraxia as well as Agoraphobia. I am deaf and have a hearing aid and I have a visual condition which restricts my field of vision.

I also have 6 disabled children to care for.

Adult social services give me carer for 10 hours per week via social care because I can go out but not alone. That should have got me 12 points. By my estimation I should have got higher rate for both. He basically said there was nothing wrong with me at all and awarded me nothing. We will see about that Mr Physio "do no harm" therapist.

Previously I got DLA lower rate for 15 years. But the other diagnosis are all new, in the last 18 months so I thought I'd transfer. I have got the assessors report already and I've just transcribed 58 minutes of interview into minuted legal form. That was painstaking to do.

That is going to the HCPC as my assessor is also a registered Physiotherapist and I'm making a complaint to them about his lies which I can prove.

Then I'm going to whack in a disability discrimination claim under legal aid, mandatory re-consideration? There will be an awful lot more than £22.00 per week to consider by the time I'm finished with that rat bag I can tell you.

I do hope he enjoyed being a Physio? Unfortunately he is bound by a code of ethics which lying through your teeth falls far short of. Whatever happens it will stay as black spot against his name on the HCPC register forever. That is if he is isn't sacked after a fitness to practice hearing. I did tell him my IQ was gifted and competence wasn't my issue.

However leaving the house to buy a pint of milk, social communication, attention, sensory processing disorder and dyspraxia are my very real issues. Maybe the cockney accent threw him and he made assumptions about being raised on a council estate and IQ?

He won't be the first.

Will they stop my money while they reconsider it all please?
