ESA (IR) Backpayments and Company Pension was created by lobsterpot
Hi Everyone

I have filled out the ESA IR form regarding a backpayment I May be due. Was wondering though

(1) Can I still receive SDA even when in receipt of a company pension
(2) Is the ESA IR Top Up means tested
(3) What sort of waiting times have B+W experienced in a decision being made

1. Do you mean SDA, this is about your ESA claim? If you are receiving a pension then this needs to be reported to the DWP as it can reduce your ESA payments.

2. Yes, ESA(IR) is means tested. It considers your household income, savings and assets and whether a partner works.

3. I don't really have any feedback on this, best guess is 3-4 weeks.

Hi

Right perhaps I haven't made it clear what I am asking.

Firstly the DWP have sent me a ESA3 (IR) regarding a possible under payment. Now being crystal clear please note the following

Receiving ESA (CB) in support group since migrating from IB
Receiving PIP Enhanced for both elements since migrating from DLA
**The DWP know I have an in payment company pension since 1999**

So can I be "Awarded or be given a backdated payment for NOT being given SDA from when I was migrated from IB to ESA.

IS that clearer?

I'm sorry but I don't know what you mean by SDA?

Do you mean Severe Disability Allowance, Income Related ESA or the Severe Disability Premium?

SDA I presume means severe disablement allowance which I have been trying to find out information on here.

I'm sorry to have wasted time so I will try and find out the answer elsewhere.

You are not wasting anybody's time but you cannot claim or receive SDA any more that's why I am struggling to provide an answer.

The ESA3 is to see whether you are entitled to receive an Income Related top-up to your existing ESA(CB) payments, your pension is not disregarded for ESA(IR) and will be deducted £ from £ from any ESA(IR) that you may be entitled to.

So whether a payment will be made will depend on how much ESA(IR) you are entitled to and how much your pension is.
