SO, I'm trying to get my head around a decision just arrived today for my application from DLA high rate mobility to claim PIP. Not a review, this was voluntarily applied for because my health had changed.

I've been on High Rate Mobility component for DLA since 1993 awarded indefinitely.

My health has deteriorated since I've ill health retired and decided to claim PIP to get the additional in what was the care component as you can no longer claim DLA.

I was awarded Enhanced in both. Hooray! I'm happy with that.

BUT - I made my claim 7/8/18
DLA was paid to motorbility and PIP will take over from the 26/12/18 OK so far, however the enhanced daily living component will not be backdated and paid from the 26/12/18 as well ("because the law says so").
My query is:
Should the daily living component be backdated to the date of claim (never before awarded ) ?

Many congratulations on the award, well done.

I am afraid there is backdating of the PIP award when a DLA award is still in payment, the Transfer legislation does not allow it.

Thanks for the quick response. Did you mean there is no backdating because legislation does not allow?
