PIP was created by Ann
Hi, I’m new to the Forum and grateful to Benefits and Works for all the fantastic advice. I had DLA from 1998, full allowance for Care and full allowance for Mobility. However, when I was transferred to PIP in 2016 following a f2f assessment, I was awarded Enhanced Rate for daily living but down graded to Standard rate Mobility component. I was distraught as I lost my car and although I phoned to make an appeal , I was so ill with stress I cancelled the appeal and have regretted it since. I have seropositive Rheumatoid Arthritis which has since worsened. I have just received a letter from DWP following them looking again at my PIP claim because of changes in the law when looking at disabled people who can’t plan and follow route because of mental health issues. It doesn’t apply to me at all and they’ve decided that I’ll remain on Enhanced Care rate and Standard Mobility rate, but in the letter they say that if things have changed for me then I must let them know. Because of the RA deteriorating and no chance of my ability to walk improving I don’t know whether to let them know now or when they look at my circumstances again in February 2019 which will be 3 years since they reduced my mobility rate and I had to hand my car back. I really need a car, but I need also to do this right so any advice, words of wisdom, folks who’ve already gone through this experience who can help, would be greatly appreciated. Forgive me if this is rambling, it’s a first for me. Thank you in anticipation for any help offered.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Whilst the DWP require claimants to notify them if their conditions change they really are not bothered if they are not told about a deterioration.
First, of all you need consider whether you can reasonably show that your walking is now limited to no more than 20m? Are there things that you do that argue against your meeting this criteria?
If you report a Change then you need to understand that doing so will result in a new Decision that will supersede your current award, whatever it is. It would be a full reassessment of your claim, new PIP2 and almost certainly a face to face assessment.
If you do report a Change then do it in writing to the DWP office dealing with the claim, I would send it using a Tracked post so that you have proof of delivery.
