Happy New Year to you guys and members.

Can you give me any information on how best to sue either Atos or the DWP as in the first place Atos lied at the assessment. Secondly the DWP took her untrue evidence even though they have had many chances to put things right with letters from me proving incompetence and lies by the Atos healthcare worker.

Unfortunately I didnt tape the interview but there are many proofs of the truth. We are due to go to Tribunal at the end of March and I am 100% certain we will win the case. The Tribunal have asked for a 75 minute hearing and dont know if thats normal?

Thank you, Carper.

That is double the time usually allocated for a hearing.

I'm afraid you will be wasting your time trying to sue ATOS and the DWP, I'm not aware of a single case where a claimant has successfully sued these organisations over assessment issues, especially as you appear to have to no evidence other than your own testimony that the report did not represent what happened in the assessment.

Hi Gordon. You probably won’t remember that about five years ago I got you to change your own details on the site about the rights of ex pats returning to the UK from Europe and I also believe I was the first to make the government pay me PIP after returning to live in the UK from Europe.

Well my next first will be to successfully sue Atos for lying at an assessment. Watch this space and keep up the good work.

Thanks for posting what you did Gordon and what you managed to print tells that it is possible to sue Atos, even the DWP and maybe even the assessor herself.

I have already told Atos and the DWP an official letter of complaint is on its way and I shall do my best to get this deceitful health worker, (Assessor) sacked from ATOS. If more of us did this maybe we wouldn't have to go through so much stress when claiming.

I have seen a solicitor who is going to take on my case on a no win no fee basis so that should tell you how confident he is that I have a case.

Solicitor gets 25% of the winning claim, I get the rest. Its a no brainer not to go ahead with it wouldn't you say?

Kind regards and Im guessing you want me to keep you updated with what happens?
