ESA change from contribution based to income based

Is it true that when the contribution allowance of ESA runs out after a year and you live with a partner/husband with an income of more than £235 a week that you will not receive any income based ESA at all?

Hi n,

The criteria is if your partner works 24 hours/week or more :

24 hour work rule for ESA(IR)

Depending on your personal circumstances an income of £235/week would probably preclude you also, under the "means test".

Of course, the 365 day limit to payment of CB ESA, only applies if in The WRAG, and not the SG :

We cannot give detailed personal advice.

Under normal circumstances a couple's income, after tax, National Insurance, and half of any contribution to a personal or occupational pension (this is not a complete list), is deducted £ for £ from any ESA(IR) that is payable, I believe that there is disregard for some of the monies which may be applicable.

If the amount of ESA(IR) exceeds the deductions then the difference will be paid to the claimant

If the ESA(IR) is fully eroded, e.g. your income after deductions is more than the payable ESA(IR), then no payments will be made and the claim will be closed.

You can get a better idea if this will affect you by using one of the online benefit calculators such as Turn2Us.org.

Hi n,

The only way to be absolutely sure that you were not entitled to any IR ESA would be to request an ESA 3 Financial Assessment Form from The DWP, when you are nearing the time of exhausting your 365 days payment of CB ESA in The WRAG.
