Hello members, can anybody help please. I am already on Incapacity Benefit and had submitted a claim for DLA. I have completed all forms and submitted. I live on the Isle of Man,( it is a part of the UK.) I have had two total knee replacements that are causing me severe pain 24/7 , these were done in 2009 and 2010. I have a degenerative spine L5/S1 due to age and serious road traffic accidents going back to 1993. All these issues are recorded on my doctors records.
I had to attend a private medical doctor for assessment. I just recieved my decision and was awarded the lower care rate and no mobility !! I intend to appeal.
At the assessment the medical examiner did not examine my knees even after I told him about my constant pain he only seemed interested with my back and gave me some movements to perform.
At the end of the assessment he did not let me read what he had written nor read it to me !! He just told me to sign it. He then walked with me to my car timing me and watching me walk.

I have also checked with my doctors reception and they tell me NO government dept has asked for my medical records.
My wife helps me out of bed at least three times per night to go to the loo and I told the specialist this.
How can a decision be made for just the low care component for the day and not for the night help as well. ????
How can any decision be made without refering to my medical records and a statement from my doctor !!???
I am in constant pain 24/7 and told them in my form I can walk NIL meters without severe pain but can walk about 250 meters with pain then need to sit down. I cannot even walk 20 meters without pain
I would be interested in any comments guys on my chance of succesful appeal !! Cheers.

Hi MB,

Although the DWP do sometimes ask a claimant's G.P. to fill in a GPFR regarding one of their patient's claim for DLA they do not have to :

They can choose to solely use the evidence provided in the Medical Report by the assessing DLA EMP.

If you were to appeal, it would be up to you to reiterate how and why you feel that you qualify for a higher award of Care Component/Mobility Component.
