Hi C,

If you have been placed into The WRAG by a Tribunal, you can only appeal this to The Upper Tier if there has been an Error in Law.

You would have to first request a written Statement of Reasons from The Tribunal within a month of the decision.

What is an Error of Law?

Tribunals – Requesting a Statement of Reasons

Appealing to The Upper Tier, DR UK Factsheet

You may need professional advice on whether there has been an Error in Law, see :

Where to get advice?

Legal Aid is still available for appeals to The UT.

Failing that, if your conditions have changed (Deteriorated or new conditions) since the date of the original adverse decision that you appealed, you can request a Supersession/Review, by contacting the DWP., you would have to provide evidence.

This would involve filling in a fresh ESA50 with a fresh WCA.
