Benefits and Work is running a FREE to MEMBERS training course on Tribunal Practice and Procedure: Making Appeals Work on the following dates:

Part 1: Tuesday 30th September from 9.30 am to 12.30 pm

Part 2: Tuesday 7th October from 9.30 am to 12.30 pm

(members should attend both sessions).

The training is on Zoom, but due to the number of attendees you will not need to use your camera or microphone during the sessions.

If you have questions during the training session you will be able to use the chat panel.

The course is designed to examine how appeals should be considered as a matter of law and ‘good practice. It is aimed at those who may be going to appeal as an unsupported appellant and representatives - both new and seasoned advisers. It is beneficial to know when going to appeal the arena that you are entering into, the key principles and expectations.     

Course content: Amongst the topics covered will be:

  • the role of the First-tier Tribunal, representative and Presenting Officer
  • the inquisitorial v adversarial arena
  • the standards of evidence and burden of proof
  • what things may and may not constitute evidence
  • vulnerable witnesses
  • tribunal’s use of ‘on the day’ observations
  • the approach to conflicting evidence
  • adverse decision - when an existing award may be reduced or removed
  • submission writing - good practice

Whilst the focus will surround disability-related type appeals (e.g. Personal Independence Payment, Disability Living Allowance, Attendance Allowance and the Work Capability Assessment) those involved in other types of appeals (e.g. overpayments and benefit sanctions) should also be able to benefit from the training.   

The course is being delivered by Mark Perlic (from the City of Wolverhampton Council’s Welfare Rights Service) and Keely Gabriel (from Benefits and Work) both of whom have extensive knowledge of and experience of appeals work.  

It is often said that many tribunals, appellants and representatives look upon an appeal as simply a means for the determination of entitlement. In practice an appeal is both a question of entitlement and a question of how the decision on entitlement has been reached. The former is determined upon reference to matters of evidence, facts and law. The latter is a matter of tribunal practice and procedure.

Who can attend: Places are limited, and we will be allocating them with the aim of getting a mix of participants:

  •  members who are representing themselves at an appeal
  •  members who are supporting others in a voluntary or paid capacity.  

You do not need previous knowledge of appeals, but it would be worth reading through one of the appeals guides in the members area relating to the benefit you are interested in prior to the training.

Please note:  the trainers will not be able to answer questions about individual cases in the course of this training.

    Hi, just would like to add another plea for these sessions to be released on video and / or transcribed (if you need anyone to transcribe, I could give it a go!). I applied to be considered but did not hear back but would still really appreciate being able to take in this knowledge and advice, like everyone else I’m sure. Thank you in advance.

    I’ve just had my letter from DWP and they have CANCELLED my higher rate Daily Living & lower rate Mobility after I WON a tribunal in July 2023! It wouldn’t be so bad but I told them i was diagnosed (last November) with Wilson’s Disease and the medication & effects of the disease are WORSE than my original claim! Yet another battle ahead! It’s mentally draining

    I am at present awaiting the outcome of a Mandatory reconsideration and as with every other I am expecting to have to go to a full appeal.  This time I have used an adviser to make sure I put everything in, so feel sure I am ready should an appeal be issued again.
    I would therefore love to do the training but neither date is possible.  Is there an alternative, please.

    I am a welfare benefits adviser who completes health assessment forms, MR’s and appeals forms. 

    I am also autistic and in the midst of the MR process for my own PIP application due to the health assessor lacking knowledge of neurodevelopment conditions and the decision maker favouring their (flawed in a number of areas) report and not addressing my supporting evidence at all 🙄 

    I am not able to attend the sessions due to working but as other people have commented, would appreciate a recording as this is a much needed resource in the changing landscape of welfare reform.

    I also think I transcript would be great.I was all set to represent myself at appeal a few months ago but the DWP backed down and awarded me enhanced awards probably because I had a really strong case as I live with a progressive neurological condition.

    Unfortunately I will not be available on the 2nd date, BUT this sounds really useful, and I hope you run this again - especially as my daughter (and I) went through a rather harrowing online PIP tribunal in 2024 (about the time when there was all that negative press about PIP claimants) - where they did not listen to her, were small faceless images in the corner of the screen,  and they did not allow me to speak upon her behalf (which she had requested) as her mind goes blank and/or she gets confused; also despite the 18 month delay to the tribunal they did not take into account her GP's letter, just relying on the original DWP refusal letter.... 

    We are considering applying for PIP again, as she now has several more recent specific diagnoses, one after finally seeing an NHS Rheumatologist after a 3yr wait?!

    Yes, I agree with many of these posts that it would be really useful to have a video/transcript of this session.   My son is on DLA and I'm sure an assessment is looming, so although I don't qualify to take part in this training at the moment, I'm sure it will be of great benefit in the future.

    I am helping my son to get PIP, and he and I agree, that this probably will be needed in the future. We would be grateful if we could see the video, as it probably would help the way we should tackle the PIP form.  A transcript would be useful, if the video wasn't available when and if we need it.  We have learnt a lot over the years, but things change, and have become more difficult.  We are so pleased to have been recommended to Benefit and Works over many years.  Thank you for your caring and professional help.

    I think this is a course that everyone claiming PIP would benefit from. So it would be even better if it could be recorded or put in print. Unfortunately I will not be able to attend at those times. I have am asking for an appeal for my daughter and making a new claim for my grandson and everyone claiming PIP knows how time consuming and brain numbing it can be.

    Fabulous, I am representing myself at my pip tribunal in the next couple of months and will benefit immensely from this. I have been successful in previous Universal Credit appeal and hope to be successful in this matter too.

    This sounds great although fortunately I do not need it. At the moment. Is it possible for the course to be transcribed somehow or saved as an instructional video for all members to view as and when?

      @Kirk Yes I'm on the same position, i don't  need it right now, as iv just sent off my re-assessment so don't expect to hear from the any time soon but I'm pretty sure I'll need to appeal, so this Info would be really valuable.

      @Boo Nightmare it would have to be a Tuesday morning, one of the mornings I have to have assistance from the district nurse.
      Is this course run at other times? Wouldn't mind paying this seems really really valuable
