Just 4% of claimants who are found fit for work succeed on having the decision overturned at mandatory reconsideration stage, DWP statistics for July 2016 show.{jcomments on}

According to the latest figures, 96% of claimants who were found fit for work and asked for a mandatory reconsideration had the decision confirmed as being correct by the DWP.

However, statistics also showed that almost 6 out of ten fit for work decisions are being overturned by tribunals, allowing the claimant to receive ESA.

So, the message remains clear: if you are refused ESA at initial claim and mandatory reconsideration stage then don’t despair, there’s a better than even chance that you will win if you go on to appeal the decision.
