When a tribunal adjourns for more evidence for a medical examination and tHe medical report is completed and sent back to the Tribunal and presume also DWP, who makes the decision thereafter on the claim, the tribunal or DM?
The DWP can make a Decision on the claim, but only one that is more favourable than the existing one, but more usually it will be the Tribunal panel that will make the Decision.
You will receive a copy of the new medical report and can make comments on it, a new hearing will be convened hopefully quite quickly, and will then hear your case and make a Decision on it.
