Hello

I think I am entitled to Income Support Top-Up on account of being placed in ESA Support Group a year ago after being migrated from IB. I have been afraid to try and claim it for fear of it triggering a new ESA assessment and I can manage on the money I have which is about £107 a week. But my sister who is in the SG and is on Income -Related ESA is getting about £123 per week. Someone I know who knows a lot about welfare rules said I should get 71.70 plus 34.80 Support Component plus 15.15 Enhanced Disability Premium = £121.65 in total (last year's rates). though he said I may only get 3 months backdating.

As Atos have put a hold on reassessments I was feeling that now would be a good time to claim it but as I say I'm terrified of triggering a reassessment and the lesser of two evils is to live without the extra money.

I would appreciate your advice.

It would be an Income Related ESA top-up to your ESA(CB) rather than Income Support.

You may be eligible, it will depend on your household income, assets and savings and any hours that a partner works.

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)

There is no reason why a re-assessment would be triggered as a result of a claimant be assessed for ESA(IR) although you will need to complete an ESA3 form to tell the DWP about your financial situation.

Whilst I cannot be 100% certain, there should be no restriction on when payment should be made from as the payment of a Premium has no backdating limit, it should be payable from when eligibility occurred not when it is claimed.
