How quick do you start getting ESA payments? was created by HarryC
With a fresh claim for ESA, how quick do you start getting the ESA payments? If they are slow in processing the initial form this would mean a claimant could be getting payments for many weeks before having at attend medical etc? And if found fit for work at medical does the person have to pay the ESA money back?

Where are ESA tribunals held? I read one poster saying it was at a Magistrates Court, that does not sound right, claimants are not criminals on trial?

Hi G and welcome to the forum. On the assumption that you are also new to the site, this FAq should help you find your way around.
Welcome to Benefits and Work
Processing of the initial claim and payment of the assessment rate is usually pretty prompt. However, it is taking many months for claimants to get the assessment out of the way and a decision made. If the claimant is accepted into the main phase of ESA, payments will be backdated to the start of the 13th week of the claim. If the claimant is found 'fit for work' there will be no need to pay back the ESA awarded to date.
When you do get your ESA50 form to complete, make sure you use our guides to help you fill it in
ESA claims and appeals
As an aside, it looks as if your username might be your real name. if you wish to change this, in order to maintain an element of anonymity, you can do so easily by following the advice in this FAQ.

The Tribunals Service are part of the courts and justice services, they are not part of DWP.
