I lose mobility due to Patellofemoral Pain Syndrome

Every day I can't use my leg for up to an hour or two due to pain.

But unsure whether this would come under the mobility for movement requirements of PIP? Does the lack of mobility need to be at least half a day?

Not making a new application, just thinking ahead when the PIP letter lands behind the door!

I am not sure that there is a clear answer to this as it may depend on the assessor and Decision Maker on the day.

You don't say how your mobility is effected for the rest of the time, this could be important, if your mobility is severely limited for a couple of hours but then you have no restriction in how far you can walk then it will be a lot more difficult to qualify than if you mobility improves but is still restricted.

The test refers to the majority of the time but this does not necessarily mean 12 hours a day, for example if you sleep 8 hours a day then your ability to walk should only be looked at in the context of the remaining 16 hours.

Also and rather confusingly (we have not seen how this is playing out with claimants yet), the regulations say that “a descriptor is satisfied on a day in the required period if it is likely that, if C had been assessed on that day, C would have satisfied that descriptor”. DWP guidance explains this as "If a descriptor applies at any point during a 24 hour period, it is considered to apply for the entire day, whereas in DLA it would have to apply for ‘the majority of the day’ in order to apply.’

Thanks.

I have been sent to hospital for confirmation of a Arthritis disease. Which will go a long way of explaining various issues inc this leg. Things are no aligned properly, however this disease contorts the bones/joints.

So as I have this about 12 years than the norm, my mobility etc will probably be a massive issue in due course. Provided the blood test result is backed up by the specialist. Rather annoyed if it is ! :(
