I did not know and understand the latter parts of this.

The reason I am quite happy for the delay in some ways, is that my
rare medical condition can only get worse by definition and. I thought
the longer the delay the worse I would get and the better the chance
Of new getting into support group.

Is this logic as faulty as my other ravings ?

Should have said that it was over 3weeks ago that l phoned atos so will be say 4 on Monday 16 th june

Hi b,

If/when you are eventually assessed under paper scrutiny (No F2F) they will make recommendations using the ESA50 that you sent to ATOS, and any other medical evidence that they have.

So the recommendations made by ATOS, which are then passed on to The DWP Decision Maker (DM) who makes the final decision would be made on that evidence alone.

If you are summoned to a F2F you could provide up to date evidence at The F2F which should be taken into account by the Assessor.

If you receive a decision without a F2F, and the decision is adverse, you could challenge the decision in that you have deteriorated, and the information in The ESA50 is not current.

Of course, DWP/ATOS could argue that they were not privy to any evidence of a deterioration in your condition at the time of any adverse decision made on paper scrutiny alone.

Thank you for giving me lots of excellent information.

This is just weird why people with long term health conditions are put
to such stress and worry. I have a panic a track every time the postman
appears.

Glad you are helping to redress the balance.

Thanks to the links in B & W's news section I now know exactly why
I have been kept waiting 58 weeks since they received my ESA50.


Mr Penning the Government Minister stated to the Parliamentary Work and Pensions Committee
very clearly (Question 52) on 11th June 2014 that :-


Over 80,000 people still have to be migrated from IB to ESA
That he slowed down IB migrations to favour New Claimants
because "they were the ones whose assessment needs had not been assessed".
He further stated that only 5,000 IB referrals were being given to ATOS each month.

This means that the backlog of over 80,000 migrations will take at least another
sixteen (16) months.

Sorry to give this news to people who really need a quick resolution, but
to others like myself it means progressive conditions will be worse and
chances enhanced of correct decision.
