Is there any way forward?

I had a car accident 21 years ago and have been on benefits of various types ever since, something early on cant remember the name, then incapacity benefit. my doctor wanted me to start part time work so after years of training one day a week, I tryed my hardest to do some work and got a small part time jobs for a few hours a week and went onto Tax credits with a disability element.

My doctor then said I could try full time work for a few months as a trail, the result was terrible - the nerve damage and pressure of work I have now lost 95% vision in one eye and the other eye is not right as I had the same thing 20 years ago which is gradually healing!

The doctor said stop working immediately and sent me to specialists who cant help me. the doctor said my nervous system was so delicate I may never work again.

I applied for Employment and Support Allowance and the past 2 years been through Tribunials who then put me on WRAG, the doctor and WRAG said "No I was a liability" so my case went to Upper Tribunial to go onto the Support Group. At this point I found a good solicitor to help me with my forms.

A letter came back to say the judge has refused my case. The solicitor said " He was deeply unhappy with the decision and did not agree with the judges findings, I can find no way in pursuing the matter or challenge the decision."

So what happens now!!!

I would love to work again but I am not allowed too or fit enough to work as I could go blind? I may never work again? I have no money or pension.

Is there another benefit I can apply for?

I would be grateful for your help?

Hi Grace and welcome to the forum. On the assumption that you are also new to the site, this FAQ should help you find your way around.

I'm sorry that you are going through this :( As your solicitor has told you, you have come to the end of the road as far as this claim is concerned. If you are single ( or have a non-working partner) and have no other income you can reapply for income-related ESA. This would start the whole process again and it is possible that you might be able to gain access to the Support Group next time round (if you believe you meet the specific Support Group descriptors). Did you use our guides to help you fill in the previous ESA50 forms?
