Hi,
I, like many others, had an assessment, received no points, I appealed, then had to go through the Tribunal process.
I won the Tribunal, which is great, but unfortunately they could only make a decision on the basis of my condition at the time of my assessment. At that time I was able to walk 200 metres.
So I was only placed in the WRAG, and as I have already received the 365 days of payment, I am no longer entitled to any further benefit. (Partner is in full time employment)
This has all been since September 2012.

I have Chronic back pain, as the doctor describes it. ( & yes, I know what a lot of people think of back problems ).

However, my condition worsened in November 2012, and I have medical history to back this up.
I am no longer able to do as much as I could and no longer able to walk 50 metres required for Descriptor 1.
I informed the Appeals and DWP about this at the time, but they disregarded this due to the Assessment Decision and Appeal going on at the time. All they kept telling me was that they could only make a decision based on the day of the Assessment.

I feel that, as the Tribunal agreed I should still have been on ESA at the time of my condition worsening, surely should I not have been advised and entitled to make a fresh claim from November 2012?????
And then, hopefully, be placed in the Support Group due to the fact of no longer being able to mobilise for more than 50 metres (descriptor 1a = 15 points)

(Can I just add that I have only just found this site & deeply regret not having found it sooner, as having read all your advice on the forms etc, I feel I would have been much better prepared for this nightmare and wouldn't be in this position :( )

Any advice would be greatly appreciated.

Based on your post you were badly advised, if you could show that a deterioration had occurred after the original assessment then you were entitled to request a re-assessment of your claim, you can still do this.

Providing that you have maintained your original Limited Capability for Work since your payments stopped, if you are still receiving NI Credits this will be the case, then you can write to the DWP requesting a re-assessment based on a deterioration.

If you are placed in the Support Group then your ESA(CB) should be re-instated from the date the DWP receive your letter and will continue as long as you remain in the SG.

Depending on your NI Contribution history there is a small chance that you may qualify for a new claim for ESA(CB), I think it unlikely from your post that you will but it is worth checking, You will need NICs in the Tax Years 2011-12 and 2012-13.

It is important you understand that Descriptor 1 is not a walking test but a test of your mobility, your ability to self propel a manual wheelchair will also be considered so you need to include evidence that you cannot use a wheelchair, whether you currently use or even own a wheelchair is not relevant.

Thank you for your quick reply.

Yes, I have maintained my Limited Ability to work and All my NI Contributions have been paid throughout this time. ( they have finally said I no longer have to supply doctor's certificates until further notice)

I don't have a wheelchair and didn't realise they would consider this, however, I'm not sure I could use one anyway as I now have a problem with my right shoulder, not sure if it's down to having to use a walking stick. I am now seeing a specialist for this condition also.
I will continue reading your guides on this.

I am able to show the deterioration of my condition, so I will request a re-assessment as you suggested.

At least I now have an idea of where to go next.
