Tax Refund trigger ESA Review was created by panaman
Hi
Feeling a bit paranoid here.
I put all my non isa savings in my partners name so he can claim the tax back on the interest which we last did last year for the 4 previous years.
I am considering doing it for the last 2013/14 Tax year but am really concerned it will trigger another ESA review for my partner.
Just after doing it last year the forms came for the transfer from IB to ESA. Coincidence?
I have been told on here and understand that a tax refund is not a change of circumstances so it won't mean a review but still feel very nervous about doing it. My partner is in the support group with review due in 2016.
I just have the awful feeling they will see we have savings and the tax man will inform the DWP as my partner look like an easy target. I know all the ESA reviews have been suspended for the time being but still feel nervous. We would rather forfeit the money than have to go through a review.
Anyone had it happen to them?
Any advice appreciated.
Thanks

Providing your partner is receiving Contribution Based ESA, then the amount of savings and assets that they have in their name will not effect their payments or cause a re-assessment of their claim.

If they are on Income Related ESA, then any transfer that results in their savings and assets exceeding £6000 is a Change of Circumstances and needs to be reported to the DWP, however, there is no reason why this would result in a re-assessment of their claim. In practice, any amount over £5500 may trigger the DWP to contact your partner about their financial situation.
