I recently claimed ESA and was turned down due to NI contributions. I have submitted an MR although I am looking for a specialist advisor as DWP are wrong. As I haven't been found fit for work or indeed unfit for work do I need to send in sick notes please? I will phone but I am having such a truly terrible time with DWP on many levels I need an opinion please.

At the moment you have no claim for ESA so you do not need to send the DWP any Fit Notes however, should the Decision be overturned you will need A Fit Note to cover you for the current period as the ESA is only payable when one is in place, so hold on to them until you see what is happening.
