dla and motability question

Hi, just wondered if any one had any advice on this situation. A recipient of high rate mobility dla and mid rate care dla decides to apply for a motability car, but cannot go ahead as he has only until March 2015 left on current award.On the phone to the dwp he explained this, they then asked if his circumstances had changed,to which he replied that yes his mobility was worse, hence his need for the car, their response was to send out a renewal form for his dla. Now the question is,does he now have to fill this form in, bearing in mind that he could ultimately lose his dla if this decision goes against him, or can he stick as he is and wait until his award runs out and he is invited to apply for pip? It looks very much as if The DWP are treating the claimant's comments made in the phone conversation as them reporting a Change of Circumstances. (C of C)

This is rather obtuse, as they cannot receive any extra "Mobility" payments as they are already in receipt of The Highest Rate.

It is however possible that they are treating it as a request to extend the period of the award, or to make a fresh assessment/award.

You need to contact the DLA Unit, and clarify whether they need to fill in and return the DLA renewal, and may wish to explain, if it is the case, that they were not reporting a C Of C, they where simply making an inquiry.

It would be normal to receive a renewal form for a DLA award that is due to expire, some 3-4 months before the expiry date.
