When will my ESA end??? was created by Kaye Todd
Hi everyone
my claim for contributory esa started 26th dec 2013...I have recently had my medical and I have been put in the WRAG as from 24th August 2014.
I am aware contributory esa is only paid for 365 days but is this from the start of the claim (in my case dec 2013) or from when I was put into wrag?
Many thanks for any help in this.

Hi,
Welcome to Benefits and Work

This can be done quite easily by following the instructions on this FAQ :
My full name is showing, how can I stop it?
Unfortunately, the 365 Day rule with respect to CB ESA is for CB ESA paid "Whilst not in The Support Group" (SG).
Therefore the CB ESA that you have received at The Assessment Phase rate from the start of your claim will count as part of the 365 Days.
Hence, from what you have written, your 365 Days entitlement to payment of CB ESA would end circa December 2014 :
12 Month Limit for ESA(CB)
Once you have exhausted your 365 days of payment, you should be financially assessed, using an ESA 3 Financial Assessment Form, (which you can request from The DWP) to see whether you can pass the means test with respect to capital, assets, savings, household income and any hours worked by a partner if you have one :
24 hour work rule for ESA(IR)
Asset rule for ESA(IR)
If you can pass the means test, payment of Income Related (IR) ESA should ensue. There is no limit to how long you can receive IR ESA.
If you are not entitled to IR ESA, all payments will cease, and you will receive NI Credits only towards your State Pension.
If you feel that you should have been placed into The SG instead of the WRAG you have one month from the date of the WRAG decision notice letter to request a Mandatory Reconsideration. (MR)
If you wish to consider the MR option, please repost to this topic and we will provide further information.
As things stand, as you have been placed into The WRAG, The WRA Component of ESA should be back dated to the start of week 14 of your claim, so you should receive any arrears owed, from that date.
