Hi I am currently on ESA contribution based and have been since March 2014 due to an accident. I am in tremendous pain and unable to get out of the house without assistance. I am awaiting further surgery where I will be in a cast and unable to weight bear. Can I ask how is ESA worked with people who have conditions that are not static ?

If your condition has changed since you completed the ESA50 then you can provide updated information to ATOS about those changes, up to and including the day of any face to face assessment that you might be asked to attend.

You should send the information to the same address as your ESA50, if you are not sure what that was then you can contact ATOS

We also recommend your sending a copy to the DWP office that is dealing with your claim, marked for the attention of the Decision Maker.

Finally, you should take a copy to the assessment, if you have one, and ask the assessor to read the documents before proceeding with the interview.

Hi Gareth , would a letter from the consultant to the doctor about my current condition be okay ? and what about a copy of my X-ray?Also my because I will be having further surgery where I will not be able to weight bear I have been told I need to try and walk as much as I can bear to build my muscle up in the other leg. I don't have any written evidence of this, this is what the physio is telling me will me saying it be suffice? I am already stressed with this and this is causing real anxiety.

A letter from your consultant may well be of help, ideally you want them to talk about you problems in the context of the ESA Descriptors; a letter that just says that you cannot work will be of little value, but one that explains you problems with mobility, how you are limited and why will be of help.

There is no reason not to send a copy of the X-Rays but you should be aware that the DWP Decision Maker is not medically trained and the ATOS assessor may also not have the skillset to interpret them as it could be a nurse or a physiotherapist rather than a doctor.

Hi 007Z,

With respect to The X Rays,

As Gordon states you could send copies of these, (I believe that you can obtain copies on a CD) but there is no gurantee that The ATOS HCP viewing them will be qualified to interpret the images.

With each X-Ray there will be a report, that should give written details of the findings.

If you could provide the associated report with the X-Rays, that would be better.

Reports made as a result of an X-Ray should be available from The Hospital where the X-Rays were taken, and may also be on your G.P. records.

If you can contact your specialist's secretary, they may be able to confirm that the report is in your Consultant's files.

If they are at the Hospital, only, and you have any problems obtaining them, you can contact : PALS at the Hospital in question.

Thanks Gordon, the letter is a detailed medical account of my right ankle but also talks about my difficulties mobilising and getting out of the house. What about the guidance from physio and trying to walk with crutches?
