DLA and section 117

My mum, 77 and was in receipt of disability living allowance. She has mental health problems and I believe her is fully funded by the NHS she is in a care home . Anyway the DLA mobility stopped seems there error in 2011 which I was not aware of . I made enquiries and they have said if she is funded by the NHS she will not get the mobility element is they correct and if so why? Her situation has not changed.

There was a change to the DLA Regulations which came into effect from 8 April 2013 which removed the Mobility component (the Care component was already not payable) for claimants who are fully funded by the NHS.

If you do not believe that your mother is fully funded by the NHS and that the Mobility component should still be in payment then I would contact a trained welfare advisor for more detailed advice, do an internet search for "welfare advice" with your postcode, town or county.

Hi 007Z,

In addition to Gordon's excellent advice, a quick internet search found the following :

As your Mum suffers with mental health issues, "mind" may be able to offer further advice, as well as you contacting a Welfare Rights Agency.
