We have received the appeal decision today and unfortunately we lost. The panel agreed that the descriptor for planning and following journeys was met by b , where he only needed prompting to be able to do this. We have to accept this now, however unjust and feel we did everything we could to bring a good case. It seems that it will be nearly impossible to gain points for mobility when suffering from a mental illness. It will be very interesting to see if anyone else has any success in this area. Sorry to hear this, I am afraid it looks like it will take an Upper Tribunal hearing to reset the guidance on this, some Lower Tribunal panels may see the sense of the argument, unfortunately their Decision are not binding on other panels.
